Welcome to AWD Engineering, LLC (“AWD Engineering,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of our website, online store, products, and related services (collectively, the “Services”).

By visiting our website, making a purchase, or using our Services, you agree to be bound by these Terms, as well as our Privacy Policy and Return & Refund Policy, which are incorporated by reference.


If you do not agree with any part of these Terms, please do not use our Services.

 

1. Overview

 

AWD Engineering designs, fabricates, and sells custom automotive components, including AWD conversion kits and related parts.

All products are intended for vehicle modification, testing, or closed-course competition use only and are not intended for use on public streets or highways.

 

2. Eligibility

To use our Services or make a purchase, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction;
  • Have the legal authority to enter into a binding agreement;
  • Provide accurate, complete, and current information during checkout; and
  • Not use the Services for any illegal or unauthorized purpose.

 

3. Account Responsibility

If you create an account with us, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

AWD Engineering is not liable for any loss or damage resulting from your failure to safeguard your account credentials.

 

4. Product Information and Availability

 

We strive to display accurate product descriptions, specifications, and pricing. However:

  • We reserve the right to correct any typographical or technical errors at any time.
  • Product availability, lead times, and pricing may change without notice.
  • All images, diagrams, and renders are for illustrative purposes only.
  • We reserve the right to refuse or cancel orders if pricing or availability errors occur.

 

 

5. Orders, Payments, and Billing

 

By placing an order, you represent that:

  • You are legally authorized to use the payment method provided;
  • You authorize AWD Engineering and our payment processors (e.g., Shopify Payments, PayPal, Affirm, or bank transfer) to charge the full amount, including applicable taxes and shipping; and
  • You agree to all terms stated in our Return & Refund Policy.

We reserve the right to:

  • Refuse or cancel any order at our discretion, including suspected fraud or unauthorized activity;
  • Limit quantities per order, household, or customer;
  • Require verification or additional documentation before processing large transactions.

 

6. Custom-Built & Made-to-Order Products

All AWD Engineering products are custom-built or made-to-order.

Accordingly:

  • All sales are final once payment is received.
  • Orders cannot be canceled, refunded, or returned after production begins.
  • Production timelines are estimates and may vary due to material availability or manufacturing conditions.
  • By purchasing, you acknowledge that you understand and agree to these conditions.

 

7. Returns, Refunds & Chargebacks

 

All purchases are governed by our Return & Refund Policy, which forms part of these Terms.

By purchasing, you acknowledge that:

  • Returns are only accepted if pre-authorized in writing.
  • A restocking fee of up to 60% may apply to any approved return.
  • Chargebacks and payment disputes filed without prior written communication will be treated as fraudulent.
  • Customers are liable for all attorney’s fees, legal costs, and damages incurred by AWD Engineering in recovering funds from fraudulent disputes.

 

 

8. Product Use & Legal Disclaimer

 

All AWD Engineering products are designed for closed-course, motorsport, display, or testing purposes.

They are not intended for use on public streets, highways, or any other public roadway and may not comply with safety, or registration regulations in certain jurisdictions.

It is the sole responsibility of the installer and/or vehicle owner to ensure compliance with all local, state, and federal laws.

AWD Engineering disclaims any liability for misuse, improper installation, or illegal operation of any product.


Use of our products constitutes your agreement that:

  • AWD Engineering is not responsible for vehicle damage, injury, or death resulting from installation or use.
  • You assume full responsibility for installation, operation, and results.
  • You release AWD Engineering from any liability arising from modification, installation, or performance of your vehicle.

 

 

9. Intellectual Property

 

All content on this website, including but not limited to images, text, graphics, CAD renders, product designs, logos, and trade names, is the intellectual property of AWD Engineering, LLC.

You may not reproduce, distribute, modify, or commercially exploit any materials without our prior written consent.

 

10. Warranty Disclaimer

 

The website, Services, and all products sold by AWD Engineering are provided “as-is” and without any warranty, express or implied.

This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.


We make no representations or warranties that:

  • The site or Services will be error-free or uninterrupted;
  • The content is accurate, complete, or up-to-date; or
  • The materials are free of viruses or harmful components.

 

Some jurisdictions do not permit limitations on implied warranties, so these limitations may not apply to you.

 

11. Indemnification

 

You agree to indemnify, defend, and hold harmless AWD Engineering, LLC, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against all claims, losses, damages, liabilities, expenses, and legal fees (including reasonable attorney’s fees) arising from:

  • Your use or misuse of the Services or products;
  • Your breach of these Terms or any applicable law; or
  • Any negligent or wrongful conduct by you or anyone acting on your behalf.


This obligation shall survive termination of these Terms or your use of the Services.

 

12. Limitation of Liability

To the fullest extent permitted by law, AWD Engineering shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:

  • Lost profits, revenue, or data;
  • Business interruption;
  • Vehicle damage; or
  • Injury or death arising from use of our products or Services.

 

You expressly agree to use AWD Engineering products at your own risk.

 

13. Governing Law & Jurisdiction

These Terms and any related disputes shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.

You agree that any legal action or proceeding arising from these Terms shall be brought exclusively in Palm Beach County, Florida, and you consent to the personal jurisdiction of those courts.

 

14. Changes to Terms

 

AWD Engineering reserves the right to modify, update, or replace these Terms at any time.

Revisions will be posted on this page with an updated “Effective Date.”

Your continued use of the Services following any changes constitutes acceptance of the revised Terms.
